1. The Terms of Use

REDSBABY ABN 68 625 563 519 (“REDSBABY”, “us”, “our” or “we”) owns and operates this Website. By using or accessing this Website you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions. If you do not agree to the Terms and Conditions, please do not use this Website.

2. Ownership of Website and Content

REDSBABY owns the Website and, unless otherwise indicated, owns or is licensed to use all content and other material appearing on the Website. The material on this Website is protected by copyright under the laws of Australia and may not be used without written permission by REDSBABY. No trade mark (whether registered or not) that is displayed on this Website may be used in any way without the prior written permission of REDSBABY or of the relevant trade mark owner.

3. Your Account

If you use the REDSBABY Website you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. REDSBABY reserves the right to refuse service, terminate accounts and/or remove or edit content if REDSBABY, acting reasonably, deems that the Customer is acting in breach of these Terms and Conditions or is using the Website in a fraudulent or improper manner.

4. Pricing

Prices displayed on the REDSBABY Website are subject to change without notice. The price of an item once ordered is fixed once the order is accepted by REDSBABY. Subsequent price changes (either up or down) will not apply to accepted orders. All pricing displayed on the Website is for online purchases only and may not be matched at a physical retail location.

5. Payment

All payments are made by a secure server, which will encrypt each transaction as a security precaution, and all payments must be made in Australian Dollars only. You may pay for an accepted order using your (a) Visa; (b) MasterCard; (c) Debit cards displaying a Visa or MasterCard logo; (d) PayPal; (e) ZipPay. If REDSBABY are unable to successfully process payment for your order, then REDSBABY may reject or cancel your order. You must not pay, or attempt to pay, for Products through any fraudulent or unlawful means. Any dispute regarding payment must be advised to REDSBABY within five (5) business days of purchase.

6. 30 Day Pram Trial

The 30 Day Pram Trial applies to JIVE² Platinum, JIVE², and METRO² pram orders only. Please note the SKIP Stroller is excluded from the 30 Day Trial Pram period.

If, within 30 days, a customer is not entirely satisfied with the pram they purchased, whether via the Redsbaby website or by phone, they can return their pram back to REDSBABY and REDSBABY will refund the purchase price. If the customer bought a pram and received a Gift with Purchase, REDSBABY request that both the pram and Gift with Purchase is returned to REDSBABY.

The 30 Day Pram Trial period commences from the date the customer’s pram order is dispatched from the Redsbaby warehouse in Sydney, Australia. REDSBABY only accept returned prams that show signs of normal wear and tear that would be expected in a 30 day trial period.

To return your pram within the 30 Day Pram Trial period, please send REDSBABY an email at info@redsbaby.com.au including:

  • The reason for the return (we use this feedback to continually improve)
  • Your contact details
  • Your order number, this can be found on your invoice
  • Product batch number, which can be found on the bottom of the chassis, near the brake

Once your email has been submitted, a member of the REDSBABY Customer Care team will contact you within five (5) business days, via email which will include a return shipping label (to be printed at home), instructions to drop off at your local post office, and a returns shipping cost. Please note, REDSBABY does not cover the cost of shipping the returned item.

The returned pram and Gift with Purchase (if applicable) must be packed in their original Redsbaby packaging. If you received a Gift with Purchase when you purchased your pram, this will also need to be returned with your pram. Please take care to repack the item(s) carefully.

Once the pram is received and inspected by REDSBABY, REDSBABY will contact you and arrange a refund of the purchase price via bank transfer (excluding the return shipping costs), to your nominated bank account. Only prams that show signs of normal wear and tear that you would expect in a 30 day trial period will be accepted. Broken, damaged or soiled prams will not be accepted.

If two or more prams have been purchased in one order, we will only accept the return of one pram as part of the 30 Day Pram Trial return.

If a customer decides to return an item within the 30 Day Pram Trial Period, and later decides to place a new order during an online promotion period, the customer will be exempt from that promotion.

The 30 Day Pram Trial applies only to JIVE² Platinum, JIVE², METRO², and JIVE² Scenic orders and does not apply to the SKIP Stroller, accessories, or any prams, strollers or accessory items that are purchased at a marked down price. The 30 Day Pram Trial commences from the date your pram is shipped from the REDSBABY warehouse in Sydney, Australia.


6.1 Colour changes in the 30 Day Pram Trial period

REDSBABY will exchange your product for another colour (subject to availability), if you change your mind in the 30 Day Pram Trial Period. To quality for this, please ensure the pram is unopened and in its original condition. To return your pram within the 30 Day Pram Trial period, so you can change pram colour, please send us an email at info@redsbaby.com.au including:

  • The colour-way you wish to swap to
  • Your contact details
  • Your order number, this can be found on your invoice
  • Product batch number, which can be found on the bottom of the chassis, near the brake

Once your email has been submitted, a member of the REDSBABY Customer Care team will contact you within five (5) business days, via email which will include a return shipping label (to be printed at home) and a returns shipping cost. Please note, REDSBABY does not cover the cost of shipping the returned item, or cover the cost of shipping out the new pram colour you wish to swap to.

7. Warranty


7.1 24 Month Warranty

The 24 Month Warranty applies to the JIVE² Platinum, JIVE², METRO², JIVE² Scenic pram, and SKIP Stroller ordered from 1st November 2017 in Australia and commences from the date the item is shipped from the Redsbaby warehouse in Sydney, Australia.

**Please note all Pram and Stroller accessories and all full priced 2017 Pram models come with a 12 Month Warranty, for further information on this please see clause 7.2. Ex-Demo Models come with a 6 Month Warranty, for more information on this please see clause 7.3.**

Our Product(s) come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to have the goods repaired or replaced if the Product(s) fail to be of acceptable quality and the failure does not amount to a major failure.

REDSBABY reserves the right to stop manufacturing a particular model, colour, fabric or accessory; in this instance REDSBABY will replace with a similar part, colour or fabric during the manufacturer’s warranty period.

The Warranty is applicable to the named above REDSBABY Prams and Strollers, sold through the Website or through any official REDSBABY physical locations. Customers should read and consider the user guides carefully before assembling and using any REDSBABY Pram and Stroller.

Named Prams and Strollers are covered against faults in material and workmanship when used under normal conditions, according to user manuals and technical specifications, for a period of 24 months from the date of dispatch of the Pram and / or Stroller from REDSBABY to the customer. The 24 Month Warranty includes all manufacturing defects relating to:


I. Chassis, frame, wheels and adaptors;
II. 5-point harness buckle, padding, strapping and assembly; and
III. All soft good seams, bindings and zippers.

 

Subject to clause 7.1.1 and 7.1.2, if a Customer discovers a fault in a Pram / Stroller's material or workmanship, and REDSBABY inspect the Pram / Stroller and confirms that it is a fault, then REDSBABY will replace the Pram / Stroller or faulty part of the Pram / Stroller, or repair the fault if notified within the 24 Month Warranty period.

7.1.1 If there is a major failure with a Pram / Stroller, the Customer is entitled to:
(i) reject the Pram / Stroller and get a refund; or
(ii) reject the Pram / Stroller and get a replacement, or one similar in value if reasonably available


If there is a minor failure with the Pram / Stroller, REDSBABY reserves the right to choose to have the Pram / Stroller repaired, replaced, or to offer a refund of the cost of the Pram / Stroller.


In the event of the Customer electing a refund for a major failure, the Pram / Stroller must be returned to REDSBABY, in its original packaging and condition at the time when the major failure was identified, and inspected by REDSBABY to confirm the reported major failure of the Pram / Stroller. Following confirmation by REDSBABY of the reported major failure, the refund will be arranged. No refund will be provided to the Customer until the Pram / Stroller is returned to REDSBABY, or REDSBABY's nominated repair agent, and the major failure confirmed.

7.1.2 To lodge a Warranty claim, the customer is required to complete the Warranty Form in the Support Centre on the Redsbaby website, and submit the form to our Customer Care team. A member of our team will contact the customer within seven (7) business days to discuss the claim and next steps.

7.1.3 Customers are liable for any transportation costs if the Pram / Stroller is not found to be faulty.

7.1.4 Customers are liable for any transportation costs if they require replacement or warranty parts to be shipped internationally, even if the Pram / Stroller is within the Warranty claim period. REDSBABY will deduct the amount from the international shipping charge, equivalent to the original shipping fee charged on the original order, to the Customer to subsidise the international shipping fee.

7.1.5 To the extent permitted by law, the following are not covered by Warranty:

  • failure or defects resulting from improper care or use;
  • normal wear and tear including scratches to the Pram / Stroller frame;
  • scuffs and tears to the Pram / Stroller's leatherette handles/bumpers;
  • Prams / Strollers purchased second hand or from an unauthorised distributor;
  • fading or discolouration of fabrics and materials due to cleaning and/or excessive sun exposure;
  • stains, discolouration or damage to leatherette, caused by the use of cleaning or sanitiser products containing alcohol;
  • faulty or incorrect assembly of the Pram / Stroller by the customer;
  • installation of a part or accessory not compatible with the Pram / Stroller and/or not manufactured by Redsbaby;
  • any modification or alteration not conducted or authorised by Redsbaby;
  • corrosion or rust on the wheels and chassis due to extreme environmental conditions, including high humidity, salt spray, ice or snow or due to insufficient maintenance of the Pram / Stroller;
  • accidental or intentional damage, abuse or neglect;
  • damage to Pram / Stroller handle bar grips or fabrics as a result of normal handling and daily use;
  • airline/transport damage: we encourage customers to check their Redsbaby Pram / Stroller carefully after it has been handled by an airline (or other transporters) and if required, submit a claim directly to the travel insurer / airline;
  • consumer dissatisfaction with the Pram / Stroller in terms of disliking the fit, weight, functionality, colour or style;
  • if the serial number has been damaged or removed; and
  • when the Pram / Stroller has not been used for normal use and in accordance with the manufacturer's instructions

7.1.6 Warranties do not apply where the Pram / Stroller is acquired for rental, hire or other commercial purpose.

7.2 12 Month Warranty

REDSBABY provides this Warranty set out in this clause for HILO High Chair, HILO Accessories, Pram and Stroller Accessories and full price 2017 models of the JIVE, METRO and PALOMA ("Products") that have been purchased in Australia.

Our Product(s) come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to have the goods repaired or replaced if the Product(s) fail to be of acceptable quality and the failure does not amount to a major failure.

Customers should read and consider the user guides carefully before assembling and using any REDSBABY Product(s). The Product(s) are covered against faults in material and workmanship when used under normal conditions, according to user manuals and technical specifications, for a period of 12 months from the date of dispatch of the Product(s) from REDSBABY Sydney-based warehouse to the Customer.

The 12 Month Warranty includes all manufacturing defects relating to:


I. Chassis, frame, wheels and adaptors;
II. 5-point harness buckle, padding, strapping and assembly;
III. All soft good seams, bindings and zippers; and
IIII. (HILO Only) Plastic parts including seat, T-bar and tray; wooden legs and metal hardware.

 

Subject to clause 7.2.1 and 7.2.2, if a Customer discovers a fault in a Product’s material or workmanship, and REDSBABY inspect the Product and confirms that it is a fault, then REDSBABY will replace the Product(s) or faulty part of the Product(s), or repair the fault if notified within the 12 Month Warranty period.

7.2.1 If there is a major failure with a Product(s), the Customer is entitled to:
(i) reject the Product(s) and get a refund; or
(ii) reject the Product(s) and get a replacement, or one similar in value if reasonably available

If there is a minor failure with the Product(s), REDSBABY reserves the right to choose to have the Product(s) repaired, replaced, or to offer a refund of the cost of the Product(s).

In the event of the Customer electing a refund for a major failure, the Product(s) must be returned to REDSBABY, in their original packaging and condition at the time when the major failure was identified, and inspected by REDSBABY to confirm the reported major failure of the Product(s). 7.2.2 Twelve Month warranty claims must be made by email to info@redsbaby.com.au.

7.2.3 Customers are liable for any transportation costs if the Product(s) is not found to be faulty.

7.2.4 Customers are liable for any transportation costs if they require replacement or warranty parts to be shipped internationally, even if Product(s) are within the Warranty claim period. REDSBABY will deduct the amount from the international shipping charge equivalent to the original shipping fee charged on the original order to the Customer to subsidise the international shipping fee.

7.2.5 To the extent permitted by law, the following are not covered by Warranty:
(i) failure or defects resulting from improper care or use;
(ii) normal wear and tear including scratches to the pram frame;
(iii) Product(s) purchased second hand or from an unauthorised distributor;
(iv) faulty or incorrect assembly of the Product(s) by the Customer;
(v) installation of a part or accessory not compatible with the Product(s)and/or not manufactured by REDSBABY;
(vi) tyre punctures;
(vii) any modification or alteration not conducted or authorised by REDSBABY;
(viii) corrosion or rust on the wheels and chassis due to extreme environmental conditions, including high humidity, salt spray, ice or snow or due to insufficient maintenance;
(ix) accidental or intentional damage, abuse or neglect;
(x) damage to handle bar grips or fabrics as a result of normal handling and daily use;
(xi) airline/transport damage: check your REDSBABY Product(s)carefully after it has been handled by the airline (or other transporters) and if required, submit your claim directly to your travel insurer/airline;
(xii) consumer dissatisfaction with the Product(s)in terms of disliking the fit, weight, functionality, colour or style;
(xiii) if the serial number has been damaged or removed; and
(xiv) when the Product(s)has not been used for normal use and in accordance with the manufacturer's instructions

7.2.6 Warranties do not apply where the Product(s) are acquired for rental, hire or other commercial purpose.


7.3 Ex-Demo Model 6 Month Warranty

Ex-Demo Models deemed faulty by Redsbaby within the 6 month warranty period will be:
(i) replaced with the same item if available; replaced with an item of similar value or replaced with a similar item in a different colour;
(ii) repaired if possible; or
(iii) refunded depending the severity of the fault.

Note: we cannot guarantee that faulty items will be replaced with an exact match.

8. Opt-In Support Call

To qualify for the support call, customers must check the “Opt-in Support call” box during “Step 5: Order Confirmation” stage of checking out. Customers must also type the nominated month they would like our customer care team to call them. During the nominated calendar month a member from the Redsbaby Customer Care team will contact the customer using the telephone details provided whilst placing their order. The team member will try and reach the customer 3 times over a period of a week (5 working days) and leave a voicemail message if possible. If they are unsuccessful in reaching the customer, they will send a follow up "Support email” and wait for the customer to get in touch.

In the event that the customer has changed their phone number since placing their order, it is the customers responsibility to notify Redsbaby. This can be done by emailing info@redsbaby.com.au or by calling our Customer Care team on 1300 344 964.

9. Dispatching Your Order

A completed order will show on your order confirmation email and profile as “Awaiting Fulfilment”. Once you’ve placed your order we are unable to change or add to your order. Please contact our Customer Care team on 1300 344 964 or by email, info@redsbaby.com.au, if you have any queries once you’ve placed your order. Once your order status has changed to “Reserved for Shipment”, we are unable to make any amends to your order shipping address. Any cancelling of orders may attract a service fee.

Provided your items are in-stock and payment has been received we will dispatch your order from our warehouse within five (5) business days. Products will generally arrive within five to ten (5-10) business days to metropolitan regions depending on Product availability. If an item is out of stock, it can be purchased on pre-order.

If Products are to be delivered to a Customer, any period or date for Delivery stated by REDSBABY is intended as an estimate only and is not a contractual commitment.  REDSBABY will use its best endeavours to meet any estimated Delivery dates but REDSBABY will not be liable for any loss or damage suffered by the Customer or any other person for failure to meet an estimated Delivery date.

REDSBABY suggest Customers request Delivery to an address where the Delivery can be signed for during business hours.

REDSBABY will not be liable for any delay in Delivery of the Products, or any failure or inability to Deliver the Products within a particular time frame. REDSBABY reserves the right to amend Delivery methods without notice.

REDSBABY shipping costs will only cover one (1) Delivery attempt; it’s the Customer responsibility to provide a Delivery address that will be attended at the time of Delivery. The Customer is responsible for paying all additional Delivery costs as charged by the Delivery company to REDSBABY before receiving addition Delivery attempts.

If all Products in an order are in-stock, REDSBABY will NOT delay dispatch to a later date. The order will be dispatched within (5) business days. If Products in an order are a combination of in-stock and pre-order items, and depending on the items in the order, all Products in the order will be dispatched when all Products in the order are back in stock.

REDSBABY will not be liable for missing or damaged Products received at time of delivery, if notice of missing/damaged Product has not been given to REDSBABY within (14) days of delivery.

10. Copyright

All copyright in the materials (including, without limitation, text, graphics, logos, icons, sound recordings and software) are owned by REDSBABY. Material procured from a third party may be the subject of copyright owned by that third party. Except as expressly authorised, and subject to the conditions prescribed under, the Copyright Act 1968 (Cth) or except as expressly permitted by these Terms and Conditions or as is reasonably contemplated by, the normal use of the service, You may not, in any form or by any means: (a) copy, adapt, reproduce, store, distribute, print, display, perform, publish, communicate to the public, make available to public or create derivative works of the whole or any part of the materials; or (b) commercialise the whole or any part of the materials, without our express written permission or, in the case of third party material, from the owner of the copyright in that material.

11. Public Statements

You must not release to the public any news release, advertising material, promotional material or any other form of publicity relating to REDSBABY without our prior written permission.

12. REDSBABY Website

When transmitting personal information from your computer to the REDSBABY Website, you must keep in mind that the transmission of information over the Internet is not always completely secure or error-free. Other than liability that cannot lawfully be excluded, REDSBABY will not be liable in any way in relation to any breach of security or any unintended loss or disclosure of that information.

The REDSBABY Website may use "cookies" to help personalise your online experience and save you time. You have the ability to accept or decline cookies. If you choose to decline cookies, you may not be able to fully experience the interactive features of the REDSBABY Website.

13. Liability

REDSBABY provides this Website and its contents on an "as is" basis, and makes no representation as to the accuracy, completeness, currency or reliability of the information contained on this Website. REDSBABY will not be liable in contract, tort (including negligence) or otherwise to you for any direct, special, indirect or consequential loss or damage (including loss of profits or loss of data) arising out of or in connection with this Website.

13.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. You may also be entitled to remedies that cannot be excluded under the Australian Consumer Law if any services supplied by us to you fail to meet a consumer guarantee under the Australian Consumer Law.

13.2 Without excluding, restricting or modifying the rights and remedies to which you may be entitled under these consumer guarantees provisions of the Australian Consumer Law or REDSBABY liabilities under those provisions:
(i) you acknowledge that the Website is provided "as is" and that we do not make any Warranty or representation as to the suitability of the Website or a Product for any purpose;
(ii) we exclude all other implied terms and warranties, whether statutory or otherwise, relating to the Site or the subject matter of this agreement; and
(iii) we will not be liable to you for indirect and consequential loss arising from or connected to this agreement in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or wilful misconduct.

13.3 The Customer is solely responsible for making an assessment that any Product is reasonably fit for the Customer’s intended purpose and required use, and such purpose or required use is in accordance with all applicable laws.

13.4 Our liability to you for loss or damage of any kind arising out of this agreement or in connection with the relationship established by it is reduced to the extent (if any) that you cause or contribute to the loss or damage.  This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.

13.5 To the extent permitted by law, REDSBABY shall not be liable for any indirect or consequential damage, losses or expenses suffered or incurred by the Customer, howsoever caused.

14. Refund Policy

14.1 Prams

As per the Redsbaby 30 Day Pram Trial, if, within 30 days, a customer is not entirely satisfied with the pram they purchased, whether via the Redsbaby website or by phone, they can return their pram back to REDSBABY and REDSBABY will refund the purchase price. If the customer bought the pram and received a Gift with Purchase, REDSBABY request that both the pram and Gift with Purchase is returned to REDSBABY.

The 30 Day Pram Trial period applies to pram orders only and commences from the date the customer’s pram order is shipped from the Redsbaby warehouse in Sydney, Australia. REDSBABY only accept returned prams that show signs of normal wear and tear that would be expected in a 30 day trial period.

Please see the information outlined in the 30 Day Pram Trial section of these Terms & Conditions for more information and the process of how to make a return in the 30 Day Pram Trial period.

14.2 SKIP Stroller and Accessories

A Customer who purchases through the REDSBABY Website or via phone order and is dissatisfied with either the SKIP Stroller or an accessory ("Product") can request a full refund of the purchase price (excluding shipping costs) provided that they notify REDSBABY of their intention to return the Product and seek a refund within 14 days from the date of Delivery of the Product to the Customer. Refund notifications must be made by email to info@redsbaby.com.au. The following additional conditions apply to returns of Products made by a Customer in accordance with this clause:


(i) this return and refund offer is limited to one (1) Product per Customer (including their spouses, partners and blood and adopted family relatives);
(ii) this return and refund offer only applies to Product purchases made through the REDSBABY Website and phone orders and email orders, it does not apply to purchases of REDSBABY Products from REDSBABY retail outlets, including REDSBABY pop-up stores, or other third parties, such as retailers, distributors or on sellers;
(iii) this return and refund offer does not apply to Products purchased through our Website or via phone order or email order which have been price matched to any third-party sites that are running promotions on REDSBABY Products;
(iv) the Product must be returned to REDSBABY repacked as originally delivered in its full packaging and shipping carton. This includes all plastic and cardboard fillers that are used to protect and stabilise the Product within the packaging during delivery. Failure to repack the Product as originally delivered without all fillers and packaging within the carton may forfeit the Customer’s refund;
(v) where, upon examination and testing of the returned Product by REDSBABY, it is found that the Product has been damaged, marked, scratched, misused, or is not in an ‘as new’ condition then, unless such condition or state of the Product was caused by REDSBABY or its courier or Delivery agent, REDSBABY shall be under no obligation to provide a refund to the Customer. A partial or full refund to the Customer on return of a Product in such circumstances will be at the sole and unfettered discretion of REDSBABY; 
(vi) if REDSBABY deems the Product to have been damaged, marked, scratched, misused, or is not in an ‘as new’ condition, and the Customer requests for the return of the original Product, then the Customer will be deemed liable for all transport costs incurred, including the initial return freight of the Product to REDSBABY and resending the Product to the Customer;
(vii) the Customer is responsible for returning the Product to REDSBABY, as well as all costs incurred in the returns process;
(viii) the Customer must be available to return the Product to REDSBABY, or REDSBABY courier or Delivery agent, on a business day (ie. not public holiday or weekend) that REDSBABY nominate (between the hours of 8am to 5.30pm) and within five (5) business days after they have notified REDSBABY in writing of their intention to return the Product;
(ix) REDSBABY reserves the right to revoke this return and refund offer at any time. In the event that REDSBABY does revoke this offer, then this offer will only be available to Customers who have purchased a Product prior to the date of the offer being revoked and who have satisfied all other conditions necessary to be entitled to rely on the offer, as are set out in this clause. A Customer who purchases a Product after this offer has been revoked, shall not be entitled to rely on the offer made by any previous and superseded Terms and Conditions which may have contained this offer;
(x) the policy applies only for Customers in Australia;
(xi) refunds are applied back via the original payment method, and once approved by REDSBABY, can take up to 5-10 business days; and
(xii) for the purposes of determining the 14 day period for the return of a Product, the date of Delivery shall be taken to be the date that the courier or Delivery agent engaged by REDSBABY delivers the Product to the shipping / Delivery address requested by the Customer.
(xiii) the full refund amount excludes all shipping costs incurred to the customer; and is equal to the amount paid for the goods only.

REDSBABY Refund Policy shall be subject to the requirements of the Australian Consumer Law, and where applicable shall be modified to the extent necessary to comply with the Australian Consumer Law and shall be supplemented where necessary to provide any additional rights and obligations upon REDSBABY and the Customer where necessary to comply with the Australian Consumer Law.

15. Cancelling an order

REDSBABY may cancel any part of an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if:
(i) the Products in that order are not available;
(ii) there is an error in the price or the Product description posted on the Website for the Product in that order;
(iii) REDSBABY deem a coupon code has been applied to an order in an unauthorised or incorrect manner, which will be at the sole and unfettered discretion of REDSBABY;
(iv) that order was paid for via direct deposit, and the Products in that order sold out while REDSBABY were awaiting the funds to be received for that order; or

(v) your order has been placed in breach of these Terms and Conditions.

16. Force Majeure

To the extent permitted by law, REDSBABY is not liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of REDSBABY, and REDSBABY shall be entitled to a reasonable extension of time for the performance of such obligations.

17. General

If the whole or any part of a provision of this agreement is void, unenforceable or illegal in a jurisdiction it is severed for that jurisdiction. The remainder of this agreement has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of this agreement or is contrary to public policy.

17.1 This agreement is governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place. Any rights or remedies to which you are entitled under the Australian Consumer Law arise independently of these Terms and Conditions and this clause does not apply to any claim you may have under the Australian Consumer Law.

17.2 REDSBABY may amend these Terms and Conditions at any time in whole or in part from time to time without notice and amendments will be effective immediately upon posting the amended version on the REDSBABY Website. By continuing to place an order for Products, the Customer will be deemed to have accepted the revised terms.

18. Product Descriptions

REDSBABY attempts to be as accurate as possible and uses its best endeavours to ensure, but does not itself warrant, that any information provided by its suppliers, including in relation to Product descriptions or other content of this site, is accurate, complete, reliable, current or error-free.

19. Definitions

In these Terms:

“Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth) and the corresponding provisions of State Fair Trading legislation.

“Customer” means the individual, organisation or entity that purchases the Product from REDSBABY.

“Delivery” or “delivered” means the time when the Products are transported from the premises of REDSBABY or its Agent and delivered to the Customer by whatever means or when REDSBABY advises the Customer the Product is available for collection and the Products are collected by the Customer.

“Product(s)” includes but is not limited to prams, strollers, parts and accessories provided by REDSBABY.
